Divorce Proceeding

There are basically 2 parts to a divorce proceeding

  1. The dissolution of the marriage; and
  2. The ancillary matters which usually would include issues pertaining to children, maintenance, matrimonial property and assets.

1st part – Dissolution of Marriage

You can apply for a divorce in Singapore only when you meet the following requirements:-

  1. You are a Singaporean or you have lived in Singapore for at least 3 years before applying for a divorce
  2. Three (3) years have passed since your marriage date unless you obtain special permission from the Court
  3. The only ground for divorce is that the marriage has irretrievably broken down.
  4. You must prove irretrievable breakdown of marriage in one of the four following ways:-
    1. Your spouse has committed adultery and you cannot tolerate it (adultery”)
    2. Your spouse has behaved in such a way that you cannot reasonably be expected to live with him/her (unreasonable behaviour)
    3. Your spouse has deserted you for a continuous period of 2 years (“desertion”)
    4. Both you and your spouse have lived apart (separated) for a continuous period of 3 years and your spouse consents to the divorce (“3 years’ separation”)
    5. Both you and your spouse have lived apart (separated) for a continuous period of 4 years (no consent is needed) (“4 years’ separation”)

2nd Part – Ancillary Matters

If you have not reached an agreement with your spouse regarding the ancillary matters, the Court has various processes in place to assist you both reach an amicable resolution before trial.

With effect from 1 Dec 2016, if there are children to the marriage below the age of 14 years, you and your spouse must attend the Mandatory Parenting Programme (“MPP”). This programme will help parents focus on the needs and welfare the children and minimise the impact of the divorce.
